Our Privacy Policy and Cookie Policy also apply to your use of this site and form part of these terms.

03Information we are required to publish

Electronic Transactions Act 4 of 2019 section 34 requires a supplier offering goods or services electronically to make certain information available on its website. For completeness, here is where each item lives:

  • Full contact details, including place of business and email address: set out in section 01 above.
  • A sufficient description of the main characteristics of what we offer: every service is itemised on the Packages page, where you can see and adjust what each package includes, and confirmed in writing before you commit to anything.
  • The full price including taxes and other costs: confirmed in writing, before you commit to anything, in the quote we send after you enquire through the Packages page. Inclusive of 15% VAT where applicable.
  • The terms of the agreement, and how you can access and keep a record of the transaction: these terms, plus the written quote and acceptance for any engagement, which we will re-send on request at any time.
  • Your cooling-off rights: set out in the next section.

04Your cooling-off right

Under Electronic Transactions Act 4 of 2019 section 35, where that section applies, you may cancel an electronic transaction without giving a reason and without penalty within seven days, counted from receipt of goods, or from the date the agreement for services was concluded.

The only charge that may be levied on you is the direct cost of returning goods. If you have already paid, you are entitled to a full refund, and that refund must be made within 30 days of cancellation.

Separately, section 34 provides that if a supplier fails to publish the required information or to give you the chance to review, correct and withdraw before placing an order, you may cancel within 14 days of receiving the goods or services.

05Quotes, prices and what actually binds us

Descriptions and prices on this site are published in good faith and kept current, but the document that governs any actual engagement is the written quote and specification we send you and you accept. Where the two differ, the signed document wins.

We will tell you before doing anything that would change an agreed price. You will not receive an invoice for work you did not agree to.

06Access to the site

Access is free of charge. Arranging what you need in order to reach the site (a device, a connection, data) is your responsibility.

We may suspend, withdraw or change all or part of the site without notice. We do not guarantee it will always be available or uninterrupted.

07Changes to the site and to these terms

We may change the site's content at any time, and content may be out of date at any given moment.

We may also revise these terms. The date at the top of this page shows when they last changed. Continuing to use the site after a change means you accept the revised terms. However, a change to these terms cannot retroactively alter an engagement already agreed in writing.

08Intellectual property

All content on this site (text, images, video, code, design and layout) belongs to Future CC or to our licensors and is protected by copyright and other intellectual property law.

You may access the site and view or print pages for your own personal or internal business use. You may not:

  • Reproduce, copy or republish content for commercial purposes without our written permission
  • Alter content, or use any illustration, photograph, video or graphic separately from the text it accompanies
  • Remove or obscure any copyright, trade mark or other proprietary notice
  • Present our work as your own, including in a portfolio or a pitch

09Client work shown on this site

Projects on our work and design pages are shown as examples of what we have built. Trade marks, logos and brand assets belonging to those clients remain theirs and appear here only to identify the work.

11Acceptable use

You may not use this site:

  • In any way that breaks an applicable law or regulation
  • To send, upload or transmit anything unlawful, defamatory, obscene, threatening or otherwise objectionable
  • To send unsolicited commercial communications through the contact form
  • To knowingly transmit viruses, malware or other malicious code
  • To gain or attempt to gain unauthorised access to the site, its server or any connected system
  • To attack the site by denial-of-service or any similar means

12Security

We take reasonable steps to keep this site secure but cannot guarantee it is free from viruses or other harmful code. You remain responsible for your own antivirus protection and your own backups.

Attempting to attack this site may be a criminal offence. Where we believe one has occurred we will report it to the relevant authorities and cooperate with them.

13Disclaimers

Content on this site is general information. It is not advice you should act on without speaking to us or to an appropriate professional first.

Subject to the section below, we make no representation or warranty that the content is complete or up to date at any given moment.

14Our liability, and what we cannot limit

This section is deliberately narrower than the boilerplate you will see elsewhere, because Electronic Transactions Act 4 of 2019 section 39 provides that any contract term excluding the consumer rights given by that Chapter is null and void. We would rather tell you that than print a clause that is unenforceable.

So, to be explicit:

  • Nothing in these terms excludes or limits your statutory rights as a consumer under the Electronic Transactions Act 4 of 2019, including the cooling-off and cancellation rights described above. Any wording here that appeared to do so has no effect.
  • Those protections apply regardless of which legal system governs the contract (section 38), so our choice of Namibian law below does not reduce them.
  • Nothing excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
  • Subject to all of the above, we are not liable for business losses (loss of profit, revenue, contracts, data, goodwill or anticipated savings) arising from your use of, or inability to use, this website itself.
  • Liability arising from work we are engaged to perform is governed by the agreement for that engagement, not by this page.

15If you have a complaint

Tell us first: email us and we will try to resolve it directly, because that is faster for everyone.

If that fails, Electronic Transactions Act 4 of 2019 section 40 lets a consumer lodge a complaint with the Online Consumer Affairs Committee in respect of non-compliance with the consumer-protection provisions of that Act. That route exists whatever we say here, and we will not ask you to waive it.

16How we use your personal information

We handle personal information as described in our Privacy Policy. In short: the contact form and the Packages enquiry are the only things on this site that collect personal data, and we use what you send to reply to you.

On marketing specifically, section 36 of the Act requires any commercial electronic message to carry our identity and contact details, a working opt-out, and the source of your address. We comply with that.

17Governing law and jurisdiction

These terms, and any dispute arising out of them or out of your use of this site, are governed by the laws of the Republic of Namibia, and the Namibian courts have jurisdiction.

As noted above, that choice does not reduce consumer protections that apply irrespective of governing law under section 38 of the Act.

If you access this site from outside Namibia you do so on your own initiative and are responsible for complying with your own local laws.
